    Yes. It is mandatory to have a work permit in accordance with the current immigration quota in Andorra. It is not permitted to start work until the authorization has been approved. The cost of the residence and its processing is borne by the employer.

    The employment contract must always be formalized in writing and signed by both parties. The employee must receive a signed copy of the contract. There are different types of contracts that adapt to each situation. However, in the case of processing a work permit, the contract must be permanent.

    Yes. The general probationary period is up to 2 months. During this time, either party may terminate the employment relationship without notice or compensation.

    Yes. All employees must receive, at minimum, the current Interprofessional Minimum Wage (SMI) in Andorra. In addition, the salary must be appropriate to the type of position and the duties performed.

    The ordinary working day is a maximum of 40 hours per week of effective work. Overtime has a limit of 12 hours per week, 48 hours per month and 426 hours per year, and is paid with a minimum increase of 40% or with equivalent rest. As for breaks, 30 paid minutes are provided for continuous working days of more than 6 hours, 1 unpaid hour for split shifts, and a minimum of 12 hours between working days. The weekly rest is at least 1 full day.

    The legal minimum is 30 calendar days or 22 working days per year worked.

    The salary may not be lower than the current Interprofessional Minimum Wage (SMI) and must be paid by bank transfer. The maximum payment period is 3 calendar days after the end of the pay period. In addition, the company must provide a detailed payslip, time record, and breakdown of deductions, including contributions to the CASS.

    The CASS is the body responsible for social security. The company must process registrations before the start of the employment relationship (up to 7 days in advance) and deregistrations within 3 calendar days after termination. Contributions are declared and paid monthly in arrears, between the 1st and the 15th of each month, based on the total salary (fixed, variable and in kind). The contribution rate is 22% in total, with 15.5% paid by the employer and 6.5% by the employee.

    The working calendar establishes annually the national and parish public holidays, which are mandatory.

    The employment relationship may end due to expiration of the contract or the project, by mutual agreement (reflected in the settlement), due to retirement, voluntary resignation by the employee, or dismissal. Non-disciplinary dismissal must be communicated in writing and entails payment of notice and financial compensation. The notice period is 12 days per year worked (with a maximum of 30 days) and the compensation is 25 days of salary per year worked (with a maximum of 365 days).
